The UK Self-Sponsorship Visa 2024: A Guide From Cromwell-Wilkes

Self-sponsorship visa UK

Starting a business in the UK as a non-citizen involves navigating complex immigration rules and business regulations. For many aspiring entrepreneurs, the Self-sponsorship visa UK presents a viable pathway to mitigate the challenges of traditional employer sponsorship. This visa route offers the autonomy to advance business ventures, free from the constraints usually imposed on foreign entrepreneurs.

What is a Self-Sponsorship Visa?

The UK Self-Sponsorship Visa is an innovative route allowing business owners to independently establish or expand their operations within the UK. It leverages the existing Skilled Worker visa framework, facilitated by a sponsor license acquired by a company established in the UK by the applicants themselves. This route allows entrepreneurs to self-sponsor their stay in the UK, bypassing the need for external employer sponsorship.

Eligibility Criteria for Self-Sponsorship Visa

To qualify for the self-sponsorship visa UK route, applicants should meet specific criteria, ensuring that only those with the necessary business experience and resources can apply. The self-sponsorship visa UK requirements include:

  • Experience: Applicants must possess relevant experience in the business sector they intend to enter or expand within the UK.
  • Business Plan: A viable business idea or plan demonstrating the potential for growth and sustainability in the UK market is essential.
  • Financial Resources: Adequate financial resources to support the establishment and operation of the business in the UK must be shown.
  • English Language Proficiency (Optional): While not mandatory for all applicants, possessing a certain level of English proficiency can be advantageous.

These criteria ensure that applicants are well-prepared to contribute positively to the UK economy.

The Application Process for the Self-Sponsorship Visa

Securing a self-sponsorship visa in the UK involves a structured process to align your business and immigration plans with UK regulations.

Stage 1: Establishing a UK Company and Applying for a Sponsor License

  • Company Formation: The initial step involves setting up your UK-based company and laying the groundwork for your business operations in the UK. This process includes registering your company with Companies House, choosing a company name, and setting up a business bank account. It is a best practice to seek professional and expert advice during this phase to ensure compliance with all legal matters and necessities.
  • Sponsor License Application: Once your company is established, the next step is to apply for a Sponsor License. This license is essential for sponsoring your Sponsorship of skilled worker visa UK, demonstrating that your company meets the self-sponsorship visa UK Home Office requirements to hire overseas workers, including yourself. The application usually takes between 6-8 weeks. During this period, the Home Office will assess your company’s suitability as a sponsor, including its ability to meet compliance obligations.

Stage 2: Creating a Human Resources Section for Your Company

  • HR Compliance: Developing a comprehensive human resources pack is imperative. This pack should include policies and procedures that demonstrate your company’s readiness and capability to sponsor skilled workers according to UK immigration laws. This process can take roughly two days, but ensuring compliance with ongoing sponsor duties is critical. An effective HR system will help manage employee records, monitor visa expiry dates, and ensure adherence to reporting and record-keeping requirements set by the Home Office.

Stage 3: Obtaining a Certificate of Sponsorship and Applying for the Skilled Worker Visa

  • Certificate of Sponsorship (CoS): After your sponsor license application is approved, you should obtain a Certificate of Sponsorship. This certificate is a virtual document with a unique number that proves you have an offer to fill a job that meets the criteria for a self-sponsorship skilled worker visa UK. The CoS includes details about the job role, salary, and the duration of sponsorship.
  • Visa Application: With the Certificate of Sponsorship, you can apply for the Skilled Worker visa. This application will involve demonstrating your eligibility under the points-based immigration system, including your job offer, salary, and knowledge of English. The application process can be done online, but you may need to attend a biometric appointment to provide fingerprints and a photograph.

The Self-Sponsorship Visa Process Timeline

The processing timeframe for this visa is approximately 4-12 weeks, depending on the case and the Home Office’s workload. To avoid delays, it is advisable to plan ahead and allow sufficient time for each stage of the process.

Advantages of the UK Self-Sponsorship Visa

Applying for the UK self-sponsorship visa route to enter and establish a business in the UK grants various benefits, particularly for entrepreneurs seeking independence and control over their business ventures.

Autonomy in Business Operations

Self-sponsorship allows you complete control over your business without needing external employer sponsorship. This autonomy is crucial for making strategic decisions that align with your business goals and vision. You can swiftly adapt and respond to market changes, ensuring your business remains competitive and innovative.

No Minimum Investment Requirement

Unlike other business visa categories, the self-sponsorship visa UK route does not stipulate a minimum investment amount. This flexibility allows entrepreneurs to scale their investments according to their business’s needs and capacity. Whether you are a small startup or planning a large-scale enterprise, the self-sponsorship visa accommodates various business models and investment levels.

Potential for Dependants to Immigrate to the UK

The self-sponsorship visa UK route lets you bring your family members and dependents into the UK, including your spouse and children under 18. This ensures you can settle in the UK with your dependents, providing a stable environment for your business and family life. Your dependants can also access the UK’s education and healthcare systems, ensuring their well-being and development.

Longer Visa Validity

The Skilled Worker visa, obtained through self-sponsorship, can be issued for up to five years. This extended validity period offers a stable and long-term basis for developing and expanding your business in the UK. It also provides peace of mind, allowing you to focus on business operations without worrying about visa renewals.

Viable Route to Settlement

Successfully running your business in the UK on a self-sponsorship visa can pave the way for permanent residence. After five years, you should be eligible for Indefinite Leave to Remain (ILR) as a skilled worker, offering permanent residency for your entrepreneurial pursuits and family life in the UK. Achieving ILR can eventually lead to British citizenship, opening even more opportunities for you and your family.

Access to the UK Market

The UK is one of the world’s leading economies, offering a robust market for various industries. You gain access to the UK customer base, sophisticated infrastructure, and a supportive business environment by establishing your business in the UK. The UK also has numerous trade agreements, providing opportunities to expand your business internationally.

Challenges and Considerations of Self-Sponsorship Visa

While the self-sponsorship visa UK offers numerous advantages, it also comes with challenges. Navigating the UK immigration system can often be a handful, and ensuring compliance with all requirements is crucial. It is essential to have a thorough understanding of the application process and ongoing sponsor duties.

We used Cromwell Wilkes during my entire visa journey. These visas included my fiance visa, 2 residency visas, and Indefinite Leave to Remain. All these applications were successful and we highly recommend them for anyone needing these services. We worked with Richard Roberts, Jessica Bishop and Christine Bacon and always felt like we were more than just billable hours. They cared about us as people and wanted the process to be successful. They were always available for meetings and took a lot of time to explain processes, impacts and consequences. I’m sure it’s always stressful to go through immigration processes, but this firm, and these wonderful people, made it work in the most efficient and least stressful manner possible. I highly recommend you choose them for your immigration needs.

I had to find an experienced Sports Law legal representative to help me with a terrible situation I found myself in. After many initial contacts with other firms, I had received a very warm and understanding reply from Richard Roberts of Cromwell Wilkes and the Sports Law Team. I immediately felt more comfortable and confident that these guys would look after my best interests. I opted for a face to face initial meeting to explain the situation and decided that I had made the right choice, as Richard Roberts and his team took great care in extracting relevant information and I felt that they were already battling on my behalf, despite not even leaving the offices! I faced a serious situation with the National Governing Body of my sport, which if I’m honest would have ended my career in sport and coaching. Richard unraveled everything and saw a number of flaws in the NGB and played a chess like strategy to turn around a sanction that had been imposed, and essentially saved my life. Richard proposed a pathway that filled the NGB with confidence and proved the previous sanctions were wrong. The team got the sanctions lifted and also managed to get me a number of aftercare support sessions from the NGB as it had taken an extreme toll on my mental health. Throughout, the Sports Law Team, especially Richard Roberts, who in my opinion is an amazing lawyer, treated me with respect, care and humility, with tonnes of patience, saw me as a human being needing help rather than just a customer. His attention to detail and background work is an amazing forensic advocate, surprised me no end and is I’m sure one of the reasons we won our case! I can’t thank Richard and the team at Cromwell Wilkes enough for the help, support and dedication that’s been given to me on my case. You really don’t know how much you saved me.
